Purposes of processing

We will process your data for administrative, accounting and tax management.

Data retention

The personal data provided will be kept for as long as the relationship with the entity is maintained and the data subject does not request its deletion. It will be kept in accordance with the legal periods established for tax and accounting matters, taking the last communication as a reference. It will not be kept for more than one year in the case of commercial information enquiries.

Automated decisions

The company will NOT make automated decisions, profiles or apply logic to your data.

Lawful basis

Lawful basis through performance of a contract or pre-contractual measures: the processing is necessary for the performance of a commercial contract to which you are a party. The type of contract is the aforementioned commercial contract or the pre-contractual relationship prior to contracting in order to send you the requested information.

As the communication of personal data is a legal or contractual requirement and a necessary requirement to enter into the aforementioned contract, the data subject is informed that they are obliged to provide the personal data, and likewise that the consequences of not doing so may result in the requested service not being provided.

Recipients

  1. During the duration of the processing, THE CONTROLLER shall not make any disclosure, except as required by law, nor any transfer.
  2. Optionally, temporary transfers will be made to IT service companies: Data Processors outside the EU, covered by applicable international transfer frameworks. The entity contracts its virtual infrastructure under a cloud computing model through a provider under the corresponding agreement.

Rights of data subjects

The data subject may exercise the following rights:

  • Right to request access to your personal data.
  • Right to request its rectification or erasure.
  • Right to request restriction of its processing.
  • Right to object to the processing.
  • Right to data portability.
  • Right to withdraw the consent given.

Any person has the right to obtain confirmation as to whether or not the entity is processing personal data concerning them. Data subjects have the right to access their personal data, as well as to request the rectification of inaccurate data or, where appropriate, request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

In certain circumstances, data subjects may request the restriction of the processing of their data, in which case we shall only retain it for the exercise or defence of claims. In certain circumstances and for reasons related to their particular situation, data subjects may object to the processing of their data. In this case, the entity shall cease processing the data, except for compelling legitimate grounds, or the exercise or defence of possible claims.

If you have given your consent for a specific purpose, you have the right to withdraw the consent given at any time, without affecting the lawfulness of the processing based on the consent prior to its withdrawal.

In the event that you feel your rights regarding the protection of your personal data have been infringed, especially when you have not obtained satisfaction in the exercise of your rights, you may file a complaint with the competent Data Protection Authority through its website: www.aepd.es.

In compliance with the provisions of Article 21 of Spanish Law 34/2002 on Information Society and Electronic Commerce Services, if you do not wish to receive further information about our services, you may unsubscribe by sending an email to the entity's email address, indicating "Do not send emails" in the subject line.

Internal reporting system (Spanish Law 2/2023)

Personal data will be processed by the controller and incorporated into the processing activity «Internal Reporting and Whistleblower Protection System», whose purpose is to comply with the legal obligation to manage the procedure referred to in Article 9 of Spanish Law 2/2023, of 20 February, regulating the protection of persons reporting regulatory infringements and the fight against corruption.

Personal data may be communicated to the judicial authority, the Public Prosecutor's Office or the competent administrative authority in the framework of criminal, disciplinary or sanctioning investigations. The data will be kept for the time necessary to comply with the purpose for which it was collected and to determine any liabilities that may arise from such purpose and the processing of the data.

No specially protected data is processed.

03Online purchase

Terms of sale.

General conditions

These general terms of sale, as well as any particular conditions that may be established, shall govern the relationships arising between Parque Acuático Torre del Mar, S.L. (hereinafter, Aquavelis) and Users who contract the provision of the services or products offered through the Aquavelis website (hereinafter, the Website).

Users of the online sales platform accessed from the Aquavelis website are familiar with electronic means of communication and are aware of the data security risks linked to their use. Users undertake to use these electronic means only in a legally acceptable manner.

The user declares to be of legal age and to have the legal capacity necessary to contract through the Website and, consequently, to be bound by these conditions.

Aquavelis may refuse admission to children under 12 who are not accompanied by adults who take responsibility for their custody and behaviour.

The purchase and use of any item sold online entails acceptance of the general and particular terms of sale, as well as acceptance of the Park's operating rules. The buyer is aware that, in the event these rules are not respected, access to the centre will be denied without any compensation.

In the case of ticket purchases, once the purchase process is completed, the user will receive by email a purchase ticket (the Ticket) with a unique control code, which will be the entry to the Park premises. This Ticket may not be photocopied, manipulated or damaged, as it would be immediately invalidated. In the case of the purchase of other products and/or services offered through the Aquavelis website, the user will receive the purchase Ticket by email.

Once the purchase process made available through the Website has been completed and the corresponding Ticket has been obtained, no exchanges or refunds will be accepted.

Liability limitations

Aquavelis disclaims all liability arising from personal or material damages caused by recklessness or non-compliance with the rules of conduct and use of the centre's facilities. Aquavelis does not guarantee the accuracy of the information presented on its website, either in its truthfulness or in its completeness.

Aquavelis is not responsible for damages resulting from telecommunications errors, technical problems, system failures or illegal manipulations of the computer systems involved, regardless of the place and form of the alteration. Likewise, any liability linked to damages caused by incorrect operation, interruptions (including maintenance) or system overload is excluded. Liability for damages caused by interconnection with other websites is also excluded. Aquavelis reminds you that incorrect operation may result from interaction with other sites unknown to Aquavelis, and assumes no liability linked to the content, products, services or other services provided by those sites.

The information offered on the website is intended only for private use and is intended to inform a person who may visit the centre. Users are warned that the information may be modified at any time without prior notice.

Modification of conditions

Aquavelis reserves the right to modify, at any time and without prior notice, these General Terms of Sale or, where appropriate, the Particular Terms of Sale. Such modifications will be published on the Aquavelis website so that they can be known by users before contracting products or services online.

Privacy when purchasing

Aquavelis undertakes not to transfer to third parties data relating to persons who purchase tickets electronically. All personal data shall be treated confidentially. Only the data necessary for the execution of the commercial process will be stored and may be used for marketing communications if previously authorised.

Particular conditions · Ticket purchase

  • It is not necessary for the user to print the Ticket in order to access the Park. You must bring the Ticket printed or show it on your mobile phone directly at the entry turnstiles; the number of tickets purchased must match those used.
  • If you have purchased VR Arcade tickets, you must reserve your slot at the VRFun stand upon entering the Park.
  • VR Arcade tickets must be used on the same day that you access Aquavelis.
  • The Ticket is valid for use on the selected day of the current season, subject to the Park's opening and closing calendar, and ceases to be valid once the season has ended. Check the Park's opening times and opening/closing calendar at www.aquavelis.es or by calling 952 54 27 58.
  • Tickets may only be purchased through the official website.
  • Tickets cannot be combined with other promotions or discounts.
  • No exchanges or refunds will be accepted.
  • Tickets are personal and non-transferable. Each Ticket is reserved for use by the person whose name and surname appear on it. Upon entry to the Park, a document (DNI, NIE or passport) allowing identification of the bearer may be required.
  • Cutting, manipulating, damaging or photocopying the Ticket is forbidden. Should any of these circumstances occur, we may deny access to the Park.
  • Should it not be possible to use the purchased tickets due to a cause whose origin is the sole responsibility of the customer (poor print quality or damage to the tickets, for example), there shall be no right to reimbursement of their amount.
  • Each Ticket has a unique control code, which allows ONLY ONE ENTRY to the Park. Once validated, it cannot be used again later.
  • The sale of the ticket to third parties is forbidden.
  • We reserve the right to close the Park, without prior notice, due to adverse weather conditions or for safety and public health reasons.
  • Should Aquavelis be forced to close after you have accessed it, totally or partially, due to weather or technical changes, the Park's rules for such circumstances would apply.
  • If you are unable to access for weather reasons or reasons beyond the centre's control, the buyer must ask for the centre's manager at that time. Failure to do so will result in the loss of any rights to which you may be entitled.

Aquavelis may at any time and without prior notice modify these Particular Terms of Sale. Such modifications will be published on the Aquavelis website so that they can be known by users before purchasing tickets online.

Applicable law and jurisdiction

For the resolution of all controversies or issues related to this website or to the activities carried out on it, Spanish law shall apply, to which the parties expressly submit. The Courts and Tribunals of Málaga shall have jurisdiction for the resolution of all conflicts arising from or related to its use.

04Regulations

Park rules.

To fully enjoy the park with family or friends, visitors are required to comply with the rules set out below.

General activity rules

  1. Do not run in wet areas.
  2. Pregnant visitors may not use activities 1 to 9 (inclusive).
  3. Diving head-first, human towers and any other activity considered risky by the company and indicated by lifeguards or signage is strictly forbidden.
  4. In the reception lakes and pools, please keep clear of a 15-metre zone around the points where users enter the water.
  5. Never leave children under 8 unattended, especially in the wave pool or the lake.
  6. Refrain from using ring-shaped floats or inflatable craft, except in attractions that specifically require them.
  7. The use of glasses, cameras, watches, bracelets, piercings, jewellery, necklaces, chokers, rigid and/or metal buckles or brooches, and glass items is forbidden on all activities (1 to 14 inclusive). As an exception, glasses fitted with a retention system such as a strap or cord may be permitted only on activities 11, 13 and 14.
  8. Wearing «street clothes» such as T-shirts or trousers other than swimwear is forbidden on all activities (1 to 14 inclusive). In case of sunburn, with medical supervision and authorisation from the head lifeguard, light T-shirts may exceptionally be permitted ONLY on attractions 11, 13 and 14.
  9. The use of attractions and pools is forbidden to people with plaster casts, bandages, rigid items or external prostheses.
  10. Always observe the activity signage, respecting turns where required.
  11. The park's closing protocol begins 30 minutes before closing time and may start earlier if capacity conditions require it. By effective closing time the park must be empty.
  12. For everyone's benefit, please pay particular attention to the instructions of lifeguards and monitors.

User rights

Rights and obligations of users and visitors (Art. 47 B.O.J.A. 22/7 No. 58/1988)

  • To make full use of the Water Activities and services in accordance with these regulations and with whatever the company determines.
  • To file complaints or claims for non-performance or abnormal or deficient performance of the services in the Complaints Book, which must be made available on request.
  • To know the prices of the different services before purchasing them.
  • To effective compensation and reparation for damages suffered or caused to the user during the due use of the Water Park facilities, in accordance with applicable legislation.
  • To truthful and sufficient information regarding the use of the Water Activities.

User obligations

Rights and obligations of users and visitors (Art. 47 B.O.J.A. 22/7 No. 58/1988)

  • Comply with the regulations governing the use of the Water Activities, as well as the individual and collective rules issued by Park Management, Lifeguards and other Park staff, in order to ensure greater safety and better hygiene in the use of the facilities.
  • Observe commonly accepted standards of coexistence.
  • Inform Park Management of any cases of febrile or contagious illness.
  • Pay the price of any services used that are not covered by the entry ticket.
  • Help maintain the cleanliness and hygiene of the Park by not throwing or leaving litter or other objects on the ground that would distort the intended use of these types of facilities.

Admission conditions

  • With the entry ticket, the visitor may enjoy all water facilities (1 to 14 inclusive), according to the characteristics of each (age, height, etc.), as many times as desired, except for sun-loungers, the cafeteria, locker services, gaming machines and any other accessory designated by the company.
  • The company may refuse admission to children under 12 who are not accompanied by an adult who takes responsibility for their custody and behaviour.
  • Admission is forbidden to anyone attempting to enter carrying weapons, even if in possession of a licence or regulatory permit, as well as any object that could be used as such and could endanger people's physical safety.
  • Animals and glass items (cups, bottles, etc.) are forbidden inside the premises. Admission may be denied to anyone who shows clear signs of being intoxicated or any other circumstance from which it can reasonably be inferred that they may disturb the order and tranquillity of the park.
  • Park Management may invite anyone to leave the facilities or expel them when they persistently or stubbornly disobey instructions issued by Management, Lifeguards or any other Water Park staff regarding the safe use of the facilities, or when they breach the rules of coexistence.
  • Visitors may temporarily leave the park premises, for no more than one hour, returning and using the facilities again without purchasing a new ticket, provided that they have notified the control staff on exit and have been given the document or pass established by the company for this purpose. Failure to comply with these formalities will be deemed a definitive departure from the water park, with loss of all admission rights and no right to refund of any part of the amount paid.
